Attendance at the pre-bid meeting is not required; however, bidders are STRONGLY encouraged to attend.
A satisfactory Bid Bond provided by an acceptable surety (or the cash equivalent) in an amount equal to five percent (5%) of the total bid shall be submitted with each bid.
The District reserves the right to reject any or all bids or waive any informalities in the bidding.
Performance and payment bonds in an amount equal to one hundred percent (100%) of the contract price will be required. The bonds must be secured by cash or must be issued by a surety company licensed in the State of South Carolina with an "A" minimum rating of performance as stated in the most current publication of "Best Key Rating Guide, Property Liability." Certificates of Insurance naming the District as an additional insured and with limits as noted in the bid documents will be required. Contractors submitting bids shall be properly licensed in the State of South Carolina to bid and perform the work on which the bid is submitted at the date of the bid.
The project is partially funded by Federal grant funds and the Contractor must comply with all applicable local and federal requirements in the bid documents, including Davis-Bacon and Section 3. Contractors are required to be registered in the federal System for Award Management (SAM.gov) prior to the contract award.
Contractors must also comply with the requirements of the Build America, Buy America (BABA) Act, 41 USC 8301 note, and all applicable rules and notices, as may be amended, if applicable to the Subrecipient’s infrastructure project. Pursuant to HUD’s Notice, “Public Interest Phased Implementation Waiver for FY2022 and 2023 of Build America, Buy America Provisions as Applied to Recipients of HUD Federal Financial Assistance” (88 FR 17001), any funds obligated by HUD on or after the applicable listed effective dates, are subject to BABA requirements, unless excepted by a waiver.
